Terms & Conditions
The Creative Tribe Art Class
1. About these terms
These Terms & Conditions apply to your use of The Creative Tribe Art Class website, workshop bookings and purchases of artwork from The Creative Tribe Art Class.
By using our website, making a booking or purchasing artwork, you agree to the terms that apply to that activity. Please read these terms alongside our Cancellation & Refund Policy, Photograph Policy, Privacy Policy, and Equality, Diversity & Inclusion Policy.
If you have any questions, please contact us at thecreativetribeart@gmail.com.
2. About The Creative Tribe Art Class
The Creative Tribe Art Class provides creative workshops and activities and displays and sells existing artwork.
Workshop bookings will typically be made through Eventbrite. Artwork purchases may be arranged through the website or by contacting us, depending on the purchasing method offered for the particular artwork.
The Creative Tribe Art Class does not currently offer commissioned or personalised artwork.
3. Website use
You agree to use this website lawfully and not to:
- Attempt to gain unauthorised access to the website or its administrative systems.
- Interfere with the website's operation, security or availability.
- Submit false, misleading or malicious enquiries or information.
- Use the website in a way that infringes another person's rights or breaches applicable law.
We may take reasonable steps to protect the website against misuse or security threats.
We aim to keep the website available and information accurate, but we cannot guarantee uninterrupted access or that every page will always be free from errors. We may update, change or temporarily suspend parts of the website where reasonably necessary.
4. Workshop bookings
4.1 Booking through Eventbrite
Workshop bookings will typically be made through Eventbrite. When you book through Eventbrite, you may also be subject to Eventbrite's own terms, booking procedures and privacy policy.
Please check the event listing carefully before booking, including the workshop date, time, location, price, format, age suitability where stated, and any materials or other information provided.
Your booking is subject to the availability and booking conditions shown for the relevant event.
4.2 Booking information
You must provide accurate information when booking. Please ensure that the contact details associated with your booking are correct so that important information about the workshop can reach you.
We may use relevant booking information to administer the workshop, communicate essential updates, manage attendance and respond to booking-related questions.
4.3 Accessibility and adjustments
The Creative Tribe Art Class aims to make its workshops welcoming and accessible.
Please state any accessibility requirements or adjustments you may need on the booking form, where a facility for doing so is provided. This helps us understand your needs and consider suitable arrangements in advance. If you cannot include this information on the form, or your needs change after booking, please contact us as soon as possible.
If the booking form does not provide an appropriate opportunity to share your requirements, or you would prefer to discuss them privately, contact thecreativetribeart@gmail.com before the workshop wherever possible.
We will consider requests individually and discuss what arrangements may be suitable. We cannot guarantee that every requested adjustment will always be possible, but we will approach accessibility requests respectfully and in accordance with our Equality, Diversity & Inclusion Policy and applicable law.
Not mentioning a requirement on the booking form does not automatically remove any rights you may have under applicable equality or consumer law. Please contact us as soon as you can so that we have an opportunity to discuss your needs.
4.4 Changes to workshop details
We aim to deliver workshops as advertised. Occasionally, circumstances outside our control may require a change to the venue, tutor, timing, materials or other arrangements.
If a significant change or cancellation occurs, we will communicate relevant information using the contact or booking details available to us and explain any options that apply.
5. Workshop cancellations, refunds and transfers
Our separate Cancellation & Refund Policy explains the rules for cancelling workshop bookings, requesting refunds and dealing with changes or cancellations made by The Creative Tribe Art Class.
These cancellation terms apply to one-off workshops and four-week courses. For a four-week course, the course place is treated as a complete booking and the cancellation notice period is calculated from the first session. Missed sessions and requests to transfer a place are addressed in the Cancellation & Refund Policy. The standard refund tiers are subject to that policy and to any statutory rights that apply.
The standard customer cancellation structure is:
- 7 or more days before the workshop: 100% refund.
- More than 48 hours but fewer than 7 days before the workshop: 50% refund.
- 48 hours or less before the workshop: No standard refund.
These terms are subject to the full Cancellation & Refund Policy, any event-specific terms communicated at booking, and your statutory rights. The precise timing and calculation of any refund will be handled in accordance with that policy.
If The Creative Tribe Art Class cancels a workshop, the options available will be explained in accordance with the Cancellation & Refund Policy.
Where a booking was made through Eventbrite, the practical process for administering a cancellation or refund may depend on the platform's procedures. Contact us at thecreativetribeart@gmail.com if you need assistance.
Nothing in these terms is intended to exclude or restrict any consumer rights that cannot legally be excluded or restricted.
6. Workshop attendance and participation
Please arrive at the time stated in your booking information and follow reasonable instructions given by the workshop organiser or tutor.
You are expected to treat other participants, staff, tutors and venue representatives with dignity and respect.
You must not engage in threatening, abusive, discriminatory or harassing behaviour, or behaviour that places other people at unreasonable risk. Where necessary to protect participants or the safe running of a workshop, we may take proportionate action, including asking someone to stop a particular activity or leave.
If you cannot attend a workshop, please contact us as soon as possible. Refunds, transfers and missed sessions are dealt with under the Cancellation & Refund Policy and any specific terms provided for the event.
Please follow any safety instructions relating to art materials, equipment, tools or the workshop environment. Tell us about relevant safety or accessibility concerns before participating wherever possible.
7. Artwork sales
7.1 Existing artwork
The Creative Tribe Art Class sells existing artwork. We do not currently accept commissions or offer personalised artwork.
Each artwork may be unique. Descriptions, photographs, dimensions, materials and other details are provided to help you understand what is being offered. Colours and appearance may vary slightly between a displayed image and the physical artwork due to lighting, photography and differences between screens.
Please contact us before purchasing if you need clarification about an artwork's size, materials, condition or other important details.
7.2 Prices and payment
Prices and any applicable delivery charges will be communicated at the point of sale or in the relevant artwork listing.
We will explain the available payment arrangements before you complete a purchase. Payment methods may vary depending on how the sale is arranged.
Any payment provider used for a transaction may have its own terms and privacy arrangements.
7.3 Availability
Artwork is subject to availability. If an artwork becomes unavailable before your purchase is completed, we will let you know. We will not knowingly represent an unavailable item as available for purchase.
7.4 Delivery and collection
Existing artwork may be available for postal delivery or collection, depending on the arrangements agreed for the item.
Where an item is to be posted, we will communicate the relevant delivery charge and arrangements before the purchase is completed. You should ensure that any delivery address you provide is accurate.
Where collection is agreed, we will communicate the relevant collection arrangements.
Delivery estimates are provided in good faith but may be affected by circumstances outside our control. If a delivery problem occurs, please contact us so that we can discuss it.
Your statutory rights concerning delivery, faulty goods, misdescribed goods and cancellation of distance purchases remain unaffected.
8. Returns, cancellations and consumer rights for artwork
The rules for returning or cancelling an artwork purchase may depend on how and where the purchase was made, the nature of the item and the circumstances.
If you wish to cancel an artwork purchase, report damage, or raise a concern about an item, contact thecreativetribeart@gmail.com as soon as possible and provide your order details and a description of the issue.
Where applicable, consumer law may provide cancellation rights for purchases made at a distance, including online purchases. Exceptions may apply depending on the circumstances. The fact that The Creative Tribe Art Class sells existing artwork rather than personalised artwork does not remove any statutory rights that apply to your purchase.
Nothing in these terms removes your legal rights in relation to faulty, misdescribed or undelivered goods.
9. Photography and promotional content
The Creative Tribe Art Class may photograph workshops, events or artwork for documentation and promotional purposes.
Photography will be handled in accordance with our separate Photograph Policy. We will respect applicable consent requirements and the choices individuals make about whether their images may be used.
Please speak to us if you have questions or concerns about photography at a workshop or event. You can contact us at thecreativetribeart@gmail.com.
10. Intellectual property
Unless stated otherwise, the website's text, branding, design elements, photographs and other original content are owned by The Creative Tribe Art Class or used with permission.
Artwork remains the intellectual property of its creator or rights holder unless rights have expressly been transferred or licensed. Buying a physical artwork does not automatically transfer copyright or grant permission to reproduce, distribute or commercially exploit the image.
You must not copy, reproduce, distribute or commercially use website content or artwork images without the appropriate permission, except where permitted by law.
If you wish to ask about using an image or other content, contact us before doing so.
11. Third-party websites and services
Our website may link to or use third-party services, including Eventbrite, Vercel and Cloudflare.
Third-party services operate under their own terms, privacy notices and service arrangements. We are not responsible for the content or policies of external websites that we do not control.
Where a booking or transaction is completed through a third-party platform, you should review the relevant platform terms alongside these terms and any event-specific information.
12. Privacy and personal information
We handle personal information in accordance with our Privacy Policy.
This may include information needed to respond to enquiries, administer workshop bookings, consider accessibility requirements, arrange artwork purchases and delivery, manage consent choices and protect our website.
Please refer to our Privacy Policy for details of the information we process, our lawful basis, relevant service providers, retention approach and your data protection rights.
13. Equality, diversity and inclusion
The Creative Tribe Art Class aims to provide a welcoming and respectful environment for participants, customers and visitors.
We do not tolerate discrimination, harassment or disrespectful conduct. We aim to consider accessibility requirements and treat people fairly, consistently with our Equality, Diversity & Inclusion Policy and applicable law.
If you have a concern about inclusion, accessibility or your experience with us, please contact thecreativetribeart@gmail.com.
14. Liability
Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability that cannot legally be excluded for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.
Subject to that, The Creative Tribe Art Class will take reasonable care in providing its services and managing its website. We are not responsible for losses arising from circumstances beyond our reasonable control, subject to applicable law.
You remain responsible for following reasonable safety instructions during workshops and for taking appropriate care when using art materials or equipment. This does not remove any legal responsibilities that The Creative Tribe Art Class has towards participants.
15. Events outside our reasonable control
Sometimes circumstances beyond our reasonable control may affect a workshop, delivery or website service. Examples may include severe weather, illness, transport disruption, venue issues, utility failures or other unexpected events.
Where this happens, we will take reasonable steps to communicate with affected customers and explain any practical options available. Any cancellation or refund will be dealt with in accordance with the applicable policy and law.
16. Changes to these terms
We may update these Terms & Conditions when our services, website, booking arrangements or legal obligations change.
The current version will be published on our website with its latest updated date. Changes will not remove statutory rights that apply to purchases or bookings already made.
Where a change materially affects an existing booking or purchase, we will take reasonable steps to communicate relevant information.
17. Governing law
These Terms & Conditions are subject to the laws of England and Wales, and the courts of England and Wales will have jurisdiction, subject to any mandatory consumer protections or jurisdictional rights that apply to you under law.
If you are a consumer, you may also benefit from mandatory legal protections in the country where you live where applicable.
